This international divorce highlights the importance of the child\u2019s habitual residence when determining applicable law and competent courts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>International Divorce and Jurisdiction in Cross-Border Families<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In this case the spouses were Dutch, married in the Netherlands, and their marriage was registered there. The husband resides in the Netherlands; however, the wife and their child currently live in Ibiza. This geographical separation created a conflict of laws, as the Dutch lawyer sought to apply Dutch legislation, which appeared more favourable for his client.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>International Divorce: Habitual Residence of the Child<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Our legal team demonstrated that, according to European private international law, the applicable law  concerning parental responsibility is determined by the child\u2019s habitual residence. Since the minor has been living in Ibiza, Spanish law must apply to all matters relating to custody, care, and parental measures.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>International Divorce and the Application of Spanish Law<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Even though the marriage was celebrated and registered in the Netherlands, this factor does not determine which legal system should govern decisions affecting the child. What truly matters is where the child actually resides at the moment the parental measures are established. This principle ensured that Spanish courts held jurisdiction over the case.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>International Divorce Agreements: Property and Child Measures<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We successfully reached a comprehensive agreement covering both the sale of the family home and all legal measures concerning the minor. Applying Spanish law not only protected the child\u2019s interests but also allowed the parties to finalise an international divorce through mutual consent, avoiding unnecessary litigation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>International Divorce: Protecting Families Through Correct Legal Strategy<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This international divorce case is a clear example of how essential it is to understand jurisdiction, applicable law, and international family regulations.
