Referring to what happened in a court of San Sebastian, we come to bring to the attention from <\/strong>TOSCANOLEX,<\/a><\/strong>a more than present issue, regarding the trafficking of marijuana drugs.<\/strong><\/p>\n\n\n\n

The above-mentioned courthouse proceeded to acquit a man who had fourteen marijuana plants planted on land adjacent to the hamlet in which he resided.<\/p>\n\n\n\n

It was understood that the \u201cmere cultivation\u201d of this vegetable \u201cdoes not assume\u201d that its \u201cproduct\u201d is \u201cpreordained to the traffic\u201d of narcotics.<\/p>\n\n\n\n

The judgment of the case before us, contemplates the possibility that in this case marijuana could be destined for the \u201cself-consumption\u201d of the accused or \u201calso to shared consumption\u201d.<\/u><\/strong><\/p>\n\n\n\n


So, pursuit of the principle \u201cin dubio pro reo\u201d absolves you of the crime against public health\u201d<\/u>
<\/strong>.<\/p>\n\n\n\n

The court ruling explains that the inhabitants of the hamlet \u201cvoluntarily facilitated entry\u201d to the policemen and \u201ccollaborated\u201d with them. After what, the next day, other policemen came to seize the plants. The plants \u201cyielded a total weight of 2.25 kilograms of cannabis-marijuana.<\/p>\n\n\n\n

DURING THE HEARING OF THESE EVENTS, THE DEFENDANT CLAIMED THAT MARIJUANA \u201cWAS FOR SELF-CONSUMPTION\u201d<\/em> AS WELL AS FOR \u201cSHARED CONSUMPTION\u201d<\/em> WITH HIS BROTHER.<\/h5>\n\n\n\n

Without, as the judgment reports, \u201cthere is evidence that narcotics trafficking was carried out in the hamlet, such as a constant drip of people in and out of the<\/em>house.\u201d<\/p>\n\n\n\n

The letter also recalls that \u201cno scales, no sachets were found at home to supply, no mechanism or tooling intended for the cultivation, drying or marketing of narcotic substances\u201d.<\/em><\/p>\n\n\n\n

The specific resolution also that the fourteen plants \u201creceived natural light, not artificial\u201d,<\/em>. As well as they were located next to the access door to the house.<\/p>\n\n\n\n

So in a nutshell, the only incriminating indication is the amount of marijuana found, 2.25 kilos.<\/p>\n\n\n\n

\u201cThere is no other evidence to prove that the defendant carried out narcotics trafficking,\u201d<\/strong><\/em> as the judicial letter insists.<\/p>\n\n\n\n
