{"id":8630,"date":"2021-02-23T10:58:09","date_gmt":"2021-02-23T10:58:09","guid":{"rendered":"https:\/\/toscanolex.es\/?p=8630"},"modified":"2021-02-23T10:58:11","modified_gmt":"2021-02-23T10:58:11","slug":"new-supreme-ruling-on-the-use-of-family-housing-after-divorce-when-a-new-couple-appears","status":"publish","type":"post","link":"https:\/\/toscanolex.es\/en\/new-supreme-ruling-on-the-use-of-family-housing-after-divorce-when-a-new-couple-appears\/","title":{"rendered":"NEW SUPREME RULING ON THE USE OF FAMILY HOUSING AFTER DIVORCE, WHEN A NEW COUPLE APPEARS"},"content":{"rendered":"\n<h4 class=\"wp-block-heading\"><strong><u>NEW SUPREME JUDGMENT ON THE USE OF FAMILY HOUSING AFTER DIVORCE, WHEN A NEW PARTNER APPEARS.<\/u><\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Supreme Court<\/strong>&nbsp;has established that the right to reside in family housing is maintained \u201cas long as the family character is retained\u201d and that:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cthe father or mother who lives with his children in a family home on a profit basis, and who introduces his new partner to live with them in a stable manner, loses the right to enjoy the use of that house.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme\u2019s ruling is a pioneer in the matter and states that the introduction of a third person in the family home extinguishes the right to use it since it has ceased to serve its former nature of family housing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this case, a couple from Valladolid divorced and the woman stayed with their children in the family home. After a while, she entered her new partner to live, so her ex-husband sued her, and she won the procedure. The Supreme explains: \u201cThe introduction of a third person causes the house to lose its old nature by serving in its use a different and different family.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is often the case that when a parent is divorced, he keeps the use of the family home.
