Desahucio, no por incumplimiento del contrato, ni por impago de renta, sino porque nuestra clienta necesitaba el piso para su hija.
Avisamos al inquilino de tener que desalojar el inmueble en un plazo de 2 meses. El arrendatario no acepto el tener que irse del inmueble, ya que según el mismo lo tenía todo en regla: su contrato en vigor, sus pagos al día….
Finalmente hemos conseguido una sentencia estimatoria, porque hemos podido probar que la propietaria de la vivienda, necesitaba el inmueble para su hija (que es un familiar de primer grado). Hemos acreditado que la propietaria no tiene otros inmuebles, que la hija reside en Málaga y tampoco tiene otros inmuebles, y necesitara la casa como vivienda habitual.
Esta actuación, la permite La Ley de Arrendamientos Urbanos.

Our success story this week is an eviction case. An Eviction not for breach of contract, or for non-payment of rent, but because our client needed the apartment for her daughter.
We notify the tenant of having to vacate the property within 2 months.
The tenant did not accept having to leave the property, since according to him he had everything in order: his current contract, his payments up to date…Finally we have obtained an estimative sentence, because we have been able to prove that the owner of the house needed the property for her daughter (who is a first-degree relative).
We have proven that the owner has no other properties, that the daughter resides in Malaga and she does not have any other properties, and she will need the house as her habitual residence. This action is allowed by the Urban Leasing Law.
