En este post os comentamos la noticia sobre el Prime bebé fruto de un régimen de Copaternidad.
¿En que consiste la copaternidad?.
Dos personas, sin ningún vinculo afectivo, amoroso o sexual entre ellos, se unen con el propósito de tener un hijo en común y después criarlo conjuntamente pero sin hacerlo en pareja ni en la misma vivienda.
Estas dos personas interesadas firmaran un acuerdo privado en el que regularan todos los aspectos relativos a la crianza…(régimen de custodia, y otros).
Una vez firmado este acuerdo, los interesados acudirán a una clínica de fertilidad a fin de llevar el tratamiento de fertilidad.
Cuando nazca el bebé podrá inscribir al padre y la madre de dicho bebé, y tendrán que firmar un convenio regulador de relaciones paternofiliales junto con una demanda de mutuo acuerdo y su posterior ratificación en el Juzgado.
Aun no existe regulación legal ni jurisprudencial que contemple esta forma novedosa de tener un hijo.
𝗧𝗵𝗲 𝗳𝗶𝗿𝘀𝘁 𝗯𝗮𝗯𝘆 𝗶𝘀 𝗯𝗼𝗿𝗻 𝗮𝘀 𝗮 𝗿𝗲𝘀𝘂𝗹𝘁 𝗼𝗳 𝗮 𝗰𝗼-𝗽𝗮𝗿𝗲𝗻𝘁𝗶𝗻𝗴 𝗿𝗲𝗴𝗶𝗺𝗲.
What does it consist of? Two people, without any emotional, loving or sexual bond between them, come together with the purpose of having a child together and then raising it together, but without doing so as a couple or in the same home.
These two interested people will sign a private agreement in which they will regulate all aspects related to parenting… (custody regime, and others).
Once this agreement is signed, those interested will go to a fertility clinic in order to undergo fertility treatment.
When the baby is born, the father and mother of said baby will be able to register, and they will have to sign an agreement regulating parent-child relations along with a demand for mutual agreement and its subsequent ratification in the Court.
There is still no legal or jurisprudential regulation that contemplates this novel way of having a child.
