¿CUALES SON LAS CONSECUENCIAS LEGALES?
El bullying no está regulado en el Código Penal.
Pero la vía que utilizan los jueces para condenar estos casos es la conducta delictiva de trato degradante hacia otra persona (art. 173.1 del Código Penal).
Siempre que la agresión o el comportamiento consista en un acoso continuado y un menoscabo a la moral del menor.
Los menores, solo aquellos mayores de 14 años, pueden ser condenados si comenten alguno de los delitos tipificados en el Código Penal.
El Juez impondrá al menor una pena, pero transformada en medidas correctoras. Asi, una pena de cárcel se convierte en programas de educación en centros, convivencias con otros grupos educativos o familias, internamientos de fines de semana o asistencias a centro de día, son algunas de ellas.
Además de las medidas correctoras, el juez impondrá al menor una obligación de pagar indemnización al menor perjudicado, y que deberá de ser satisfecha por los padres.
Sin embargo, ¿se puede exigir responsabilidad al centro escolar?
Si es posible siempre que se pueda demostrar la pasividad del centro escolar, y que no se adoptaron medidas para solucionar el problema.

BULLYING WHAT ARE THE LEGAL CONSEQUENCES?
Bullying is not regulated in the Penal Code, but the way that judges use to condemn these cases is the criminal conduct of degrading treatment towards another person (art. 173.1 of the Penal Code), provided that the aggression or behavior consists of a continued harassment and damage to the minor’s morale.
Minors, only those over 14 years of age, can be sentenced if they commit any of the crimes defined in the Penal Code.
The Judge will impose a sentence on the minor, but transformed into corrective measures.
Thus, a prison sentence becomes education programs in centers. Coexistence with other educational groups or families. Weekend confinement or attendance at a day center, are some of them.
In addition to the corrective measures, the judge will impose on the minor an obligation to pay compensation to the injured minor, which must be satisfied by the parents.
However, can the school be held accountable?
If possible, as long as the passivity of the school can be demonstrated, and that no measures were adopted to solve the problem.
