Existen muchas empresas que contratan los servicios de empresas de recobro para intentar cobrar su deuda porque les ha resultado imposible o, porque saben que un proceso judicial se puede alargar en años. Pero el acoso telefónico de las compañías de recobro se puede denunciar.

Las empresas de recobro intentan reclamar la deuda por todos los medios posibles; cartas, burofax, emails, SMS, miles de llamadas al deudor y a hasta las personas mas cercanas a éste. 

La práctica que utilizan estas empresas en sí no es ilegal, pero si cuando rebasan ciertos límites legales como presionar a los deudores de forma insistente, intimidarlos, amenazarlos…en tales casos estarían atentando contra los derechos y libertades de los deudores, y, por ende, cometiendo un delito penal.

Así pues, si se da el caso de que; recibes llamadas a lo largo del día de forma repetitiva e insistentes, podríamos estar ante un delito de acoso y/o coacciones, y si recibes amenazas, estaríamos ante un delito penal de esa naturaleza.

Es esencial que cuando se presente la denuncia se acompañen pruebas que justifiquen esta práctica ilegal de las empresas de recobro; grabaciones de voz, registro de llamadas recibidas, cartas de reclamación, …
