SURCHARGE OF 10% OF THE COMMUNITY FEE TO DEFAULTING OWNERS
If you have defaulters in your community of Owners, there is a legal method of persuasion to try to get them to pay the debt, this is to apply a maximum surcharge of 10%, that is, if you do not pay the monthly fee, the rest of the current fee will be charged. It will add 10% of it, for example, if the monthly payment is €100.00, the surcharge would be €10.00, that is, you would have to pay €110.00.
In order for this to be required, the following requirements must be met:
1.- Establish as an item on the agenda in the Call for the Owners Meeting, put the 10% surcharge to a vote.
2.- At the Owners Meeting, approve the proposed agreement by simple majority
3.- The surcharge must be a maximum of 10%
4.- The surcharge will be applied from the publication of the minutes of the Owners Meeting.
